Crypto's biggest legislative moment in years ended in a Senate procedural defeat. WTI crossed $106. Bessent testified that his buyback program was successful while the 10-year sat above 5%.

The Session Closed With the Fed, Crypto, and Oil All Unresolved.
The Dow fell more than 360 points. The S&P dropped 0.5%. The Nasdaq slid 0.9%. WTI closed above $105, up more than 4% on the session. The 10-year yield held at 5%. The session marked the sixth decline in the past seven.
The Clarity Act, the crypto market structure bill, failed its Senate procedural vote 49 to 51, falling short of the 60 needed to advance. Coinbase (COIN) fell 9%. Strategy (MSTR) fell 4%. Bitcoin dropped below $76,000.
Then Bessent sat before Congress, declared his bond buyback program successful, and the 10-year sat above 5% the entire time he spoke.
TQ Trade Implication
Three stories hit simultaneously and none resolved cleanly. The Fed decision lands tomorrow at 2pm. Warsh's press conference at 2:30pm is the first time investors find out what hikes follow the hike.
In January, Gold Touched Nearly $5,600 an Ounce. Today It's Around $4,100.
So the story's over, right?
Then explain this.
The metal is still leaving the vaults. Physical deliveries still running at levels the exchange rarely processed before. Central banks still buying. Dealers charging 30-40% premiums over paper price for real coins.
When price falls but physical demand doesn't — only one of those two is telling the truth.
The paper market sets the price. The physical market sets the deadline.
Anyone who wished they'd bought miners before January's run just got handed the entry back.
One company I've been tracking controls an 88 million ounce deposit — trading near $4 billion. About 1% of the value of its metal in the ground.
That gap is the whole opportunity.
The Clarity Act Failed. Crypto Just Lost Its Best Shot at Regulatory Clarity.
The Senate procedural vote on the Clarity Act fell nine votes short of the 60 needed to advance. The bill would have established which crypto assets are securities and which are commodities. Without it, that question stays in legal limbo.
The timing made it worse. The vote landed the same day the Justice Department announced it seized $61 million in crypto linked to Iranian oil money laundered through Chinese actors. Every exchange with Chinese counterparty exposure now faces heightened regulatory scrutiny without the legislative framework the Clarity Act would have provided.
Coinbase fell 9%. Circle (CRCL) dropped 9%. Robinhood (HOOD) fell 3%. The crypto ETF market also pulled back. The bill can be reintroduced in the next legislative session but that comes after November's midterms and whoever wins those changes the math entirely.
The November midterm outcome now directly shapes whether crypto gets another shot at the Clarity Act. A Democratic sweep is the scenario investors are least prepared for on crypto regulation. That is what to price from here.

Bessent Said His Buybacks Worked. The 10-Year Sitting at 5% While He Spoke Told a Different Story.
Bessent testified before the House Financial Services Committee and defended the Treasury's bond buyback program as successful. His argument: yields might have climbed even higher without it. The 10-year yield sat above 5% the entire time he was speaking.
A Bank of America fund manager survey found that nearly half of respondents expect the buyback program to have no effect on yields. Another 29% expect it to actually push yields higher. That is not a fringe view. That is institutional consensus.
Bessent also said Trump's intent on the $5,000 payment to every American adult is "very real" and that he believes there are ways to do it without affecting the deficit. He did not explain how. Bond markets are watching the fiscal side of this equation just as closely as the oil side.
TQ Edge Setup
The gap between what Treasury is saying and what bond markets are pricing is the defining tension heading into Wednesday's Fed decision. If Warsh acknowledges that fiscal dynamics are contributing to yield pressure, that is the first honest framing of the problem. Watch for that language specifically.
Aerospace Got Downgraded on a Fleet That Gets Younger.
Melius Research's Scott Mikus cut five aerospace names to hold from buy Monday: GE Aerospace (GE), Honeywell Aerospace (HONA), TransDigm (TDG), Heico (HEI) and Woodward (WWD). "Great times don't last forever," he wrote. GE fell about 2% to $317.
The argument is the aftermarket. These companies make most of their money on parts and service, not on selling engines. That business boomed because production problems kept new jets scarce while travel demand held, leaving an aging fleet flying longer.
Mikus expects retirements to rise to roughly 3% of the global fleet annually from about 2% over 2020 to 2025. Higher fuel pushes airlines toward efficiency, and Boeing and Airbus are catching up on deliveries. A younger fleet needs fewer replacement parts.
The valuations are what make a normalization hurt. GE trades near 41 times estimated 2026 earnings against roughly 19 for the S&P 500. Heico sits at 50, TransDigm 36. Mikus cut his GE target to $350 from $428 against a street average near $400.

The aftermarket thesis was the bull case for aerospace, priced at twice the market multiple. Mikus is early in calling the top and says so. But the mechanism does not need $100 oil to work. It needs Boeing and Airbus to deliver, and that is already happening.
- Bank of America's (BAC) fund manager survey found that thebiggest tail risk for markets is now a disorderly rise in bond yields. Replacing the AI bubble from last month. Money managers are the most underweight bonds since May 2022. Nearly a third said they would need to see 6% on the 30-year before shifting to overweight. The 30-year is currently at 5.37%. The distance between current levels and when institutions start buying is smaller than it looks.
- Bank CEOs at conferencespainted a surprisingly resilient consumer picture. Wells Fargo CFO Mike Santomassimo said spending has been strong across the board with no meaningful change. Bank of America CEO Brian Moynihan pointed to cruise bookings, restaurants, and movies recovering. PNC President Mark Wiedman said the post-Covid spending wall never arrived. The consumer is spending on experiences even as fuel and borrowing costs climb.
- China's economy showed awidening divide in August. Retail sales grew just 0.4% year over year, missing the 0.8% forecast. Industrial output surprised to the upside at 5.2%. Strong factory production alongside weak consumer spending is the specific imbalance Beijing has been unable to close. The NBS called it an "acute" mismatch between supply and demand. With Iranian oil sales disrupted, Chinese importers are also paying more for the energy that runs those factories.
Crypto lost its legislative moment.
The 10-year held above 5% through the entire Bessent testimony. WTI closed above $105 with the Saudi pipeline still shut. The Dow fell 360 points for the sixth decline in seven sessions.
The hike odds are at 92%. That part is settled. What is not settled is what comes after it. The market will find out tomorrow at 2:30pm whether Warsh says enough to answer that question or makes it worse.
